1.Definitions
In these terms, unless the context indicates otherwise:
- “Mylz”, “we”, “us” or “our” means Mylz Auto (Pty) Ltd, registration number [to be confirmed], trading as Mylz Rentals.
- “You” or “the renter” means the person named as the main driver on the rental agreement and, where the booking is made by a company, that company and its nominated driver(s) jointly.
- “Authorised driver” means you and any additional driver who has been verified by us and named on the rental agreement.
- “Vehicle” means the vehicle described in the rental agreement (or any replacement), including its keys, remotes, tyres, spare wheel, tools, accessories, documents, licence disc and any extras supplied with it.
- “Rental agreement” means these terms, your booking confirmation, the handover and return condition reports, any protection plan and extras you select, and any written addendum (including an extension confirmed in writing).
- “Rental period” means the period from the agreed handover time until the vehicle, its keys and documents are returned to us and checked in.
- “Damage waiver” means the contractual reduction of your liability for loss of or damage to the vehicle that Mylz offers through its protection plans, as described in clause 14.
- “Excess” means the maximum amount you must pay for each incident of loss or damage while a damage waiver applies.
- “Owner Partner” means a private owner who has placed a vehicle with Mylz under a vehicle management agreement.
- “CPA” means the Consumer Protection Act 68 of 2008, “ECTA” the Electronic Communications and Transactions Act 25 of 2002 and “POPIA” the Protection of Personal Information Act 4 of 2013.
2.Who you contract with
Your rental agreement is with Mylz Auto (Pty) Ltd only. We rent you the vehicle as principal, in our own name and for our own account, and we are responsible to you for performing the agreement.
Some vehicles in our fleet are owned by Owner Partners who have placed them with us under a vehicle management agreement. Owner Partners are not parties to your rental agreement: you have no contract with, and should not contact, negotiate with or make payments to, a vehicle's owner. All bookings, payments, complaints, claims and communications go through Mylz. Similarly, an Owner Partner has no direct claim against you; any claim relating to the vehicle is made by Mylz.
These terms apply in addition to your rights under the CPA. Where the CPA applies to you, nothing in these terms is intended to limit or exclude any right you have under it. If you rent on behalf of a juristic person whose asset value or annual turnover is at or above the threshold set under the CPA, the CPA may not apply to that rental.
3.Driver eligibility
Every authorised driver must, at handover:
- meet the minimum age for the vehicle category (generally 21 years; higher for some categories, as set out below and on each vehicle page);
- have held a full driver's licence for at least the minimum period required for the category. Learner's licences are not accepted;
- produce the original, valid licence. A licence not in English, or without a photograph, must be accompanied by an International Driving Permit (IDP). Foreign visitors should also carry their passport;
- produce a valid South African ID document or smart card, or a passport; and
- for the main driver, present a credit card in their own name for the security deposit (debit, prepaid and virtual cards are not accepted for deposits unless we agree otherwise in writing).
| Category | Minimum age | Licence held for | Standard deposit |
|---|---|---|---|
| Compact | 21 years | 1 year | R2,500 |
| Executive Sedan | 23 years | 2 years | R5,000 |
| Premium SUV | 23 years | 2 years | R7,500 |
| Luxury | 25 years | 3 years | R15,000 |
| Electric | 23 years | 2 years | R7,500 |
| Double-Cab Bakkie | 23 years | 2 years | R6,000 |
| People Carrier | 23 years | 2 years | R6,000 |
Individual models may carry a higher minimum age or licence period, shown on the vehicle page and in your quote. Drivers under 25 pay a young-driver surcharge of R150 per day, capped at R1,500 per rental.
4.Bookings, quotes & pricing
You can book through our website or app, by WhatsApp, e-mail or phone. A booking is confirmed only when we send you a booking confirmation and any required payment has been received. Until then, a quote is an offer that we may withdraw if the vehicle is no longer available or the quote contains an obvious error.
All prices are in South African rand (ZAR) and include VAT at 15%. Your quote shows, separately where applicable: the daily or period rental rate; the Tourism Marketing South Africa (TOMSA) levy of 1% on the rental charge; a contract fee of R99; the airport meet & greet fee or delivery and collection fees for your address or delivery zone; your protection plan; extras (such as additional drivers, child seats, a cross-border letter or a chauffeur); and any young-driver surcharge. The minimum rental is 24 hours and the maximum online booking is 90 days.
You book a vehicle model “or similar”. If the model you booked is unavailable for reasons beyond our reasonable control, we will offer a vehicle of the same or a higher category at no extra charge. If we cannot, you may cancel for a full refund, or accept a lower category with a refund of the price difference.
Dynamic and seasonal pricing applies. The price shown in your booking confirmation is the price you pay for the booked period and options; changes you make afterwards are re-quoted at the then-current rates.
5.Payment & security deposit
Payment can be made online through PayFast or Yoco (card, instant EFT and other methods they support) or by bank transfer (EFT) to our bank account. Unless we agree otherwise, the full rental charge must be paid before handover. EFT bookings are confirmed once the funds reflect in our account. We do not store your full card details; card payments are processed by the payment gateway.
We release the deposit hold after the vehicle has been returned and checked in, normally within 2 business days if there are no charges. Your bank may take a further 7–14 business days to show the release. See Damage, Excess, Deposits & Fines for detail.
6.Verification & our right to refuse
To protect you, our Owner Partners and our fleet against fraud and theft, we verify every renter and additional driver before handover — handover will not take place until verification is complete. Verification may include checking your ID or passport and driver's licence, a selfie and liveness check matched to your ID photo, and checks against fraud-prevention and industry risk databases and our own records of previous rentals. A successful verification is generally valid for 12 months.
We process this information under our Privacy Policy (POPIA). Documents are stored encrypted and accessed only by authorised staff and our verification provider.
We may decline or cancel a booking if verification cannot be completed, if information you gave us is false or incomplete, if a check indicates a material risk of fraud, non-payment or misuse, or if a driver appears to be impaired at handover. If we decline for these reasons before handover we refund amounts you have paid, less any reasonable charge permitted by law where the refusal results from your own false information or failure to provide required documents. We will never refuse service on a ground of unfair discrimination prohibited by the CPA or the Constitution.
7.Handover, inspection & condition reports
We are a service-area business without a public rental counter. Vehicles are handed over and returned by our team either through a meet & greet at Cape Town International Airport or by delivery and collection to an address in our Cape Town delivery zones and the Winelands, at the time and place in your booking confirmation. Please be on time: if you are more than 60 minutes late without letting us know, we may treat the booking as a no-show (see clause 18), and waiting time or a re-delivery fee may apply.
At handover we inspect the vehicle with you and record its condition, fuel or charge level and odometer reading in a digital condition report with date- and time-stamped photographs. You (and our team member) sign the report electronically. Check the report carefully and point out any damage not recorded before you drive away; we will add it. The same process is followed at return.
We supply the vehicle clean, roadworthy, licensed, with a full tank (or the charge level stated for electric vehicles) and with the documents required by law. The vehicle's licence disc and any cross-border documents must stay in the vehicle.
8.Permitted & prohibited use
You must use the vehicle carefully and lawfully, in accordance with the National Road Traffic Act 93 of 1996 and its regulations, keep it locked when unattended, and keep the keys in your personal control at all times.
Smoking and vaping are not permitted in any vehicle. A specialist cleaning and deodorising fee of R2,500 applies if the vehicle shows evidence of smoking. A cleaning fee of R750 applies if the vehicle is returned excessively dirty (for example with sand, mud, pet hair, food or spills), beyond normal use.
You may not sell, sub-let, lend, pledge or otherwise deal with the vehicle, or alter, modify or brand it.
9.Cross-border travel
Selected vehicles may be taken to Namibia, Botswana, Eswatini and Lesotho only with a cross-border letter of authority issued by us. Request it when booking, and at least 72 hours before handover; a cross-border fee applies and is shown in your quote. Some categories (for example certain luxury and electric vehicles) may not cross borders.
You are responsible for border fees, road permits, cross-border charges, any compulsory third-party insurance and compliance with the laws of each country.
10.Kilometre allowance
Your quote shows the kilometre allowance for the vehicle (a daily allowance, pooled over the rental period, or unlimited kilometres). Kilometres travelled beyond the total allowance are charged at the per-kilometre rate shown on the vehicle page and in your booking. The odometer readings on the handover and return condition reports are used to calculate distance. If the odometer fails, tell us immediately; distance will then be calculated from the vehicle's tracking data.
11.Fuel & charging
Our policy is full-to-full: the vehicle is supplied with a full tank and must be returned with a full tank of the correct fuel. If it is not, we charge for the fuel needed to fill it at R35 per litre plus a refuelling service fee of R250, unless you bought a prepaid fuel option. Keep your final fuel slip as proof.
Electric and plug-in hybrid vehicles are supplied with the charge level shown on the handover report and must be returned with at least the level stated in your booking, failing which a reasonable charging fee applies.
12.Return, late return & early return
Rental is charged in 24-hour periods from the handover time. You must return the vehicle, keys and documents at the agreed time and place. A grace period of 59 minutes applies. After that, late return is charged at R150 per hour, up to the cost of an additional rental day at the applicable rate; beyond that, further days are charged.
Extensions are subject to availability and must be confirmed by us in writing (including via your account, e-mail or WhatsApp). The protection plan and extras continue at the same rates for the extension.
Early return: if you return the vehicle early, the rental may be re-rated to the shorter period. Unused days are not refunded unless we agree in writing or the early return is due to our fault. This does not affect your rights under section 14 of the CPA where your agreement is a fixed-term agreement to which that section applies (for example certain long-term rentals): you may then cancel on 20 business days' written notice, subject to a reasonable cancellation charge.
13.Vehicle swaps, breakdowns & accidents
Breakdowns. Our vehicles are serviced and inspected between rentals. Roadside assistance is included for mechanical and electrical failure; call our 24/7 line on +27 69 644 1767. Do not arrange your own repairs without our approval — we refund reasonable approved costs against receipts. If the breakdown is not your fault, we will repair or replace the vehicle as soon as reasonably possible. Call-outs caused by you (for example lost keys, keys locked in the vehicle, running out of fuel or a flat battery from lights left on) may be charged unless your protection plan includes them.
Vehicle swaps. We may ask to swap the vehicle during a long rental for servicing, a recall or a safety reason. We will arrange this at a convenient time and place and provide a vehicle of the same or a higher category at no extra charge.
Accidents. In an accident: make sure everyone is safe and call emergency services if needed; contact us immediately; exchange details with the other parties (names, ID numbers, phone numbers, addresses, registration numbers and insurers); photograph the scene and the vehicles; and do not admit liability or make any offer of payment.
You must co-operate with us, our insurers and assessors in any investigation, claim or legal proceedings, and may not settle any claim relating to the vehicle without our written consent.
14.Damage waivers & excess
Mylz offers three protection plans. They are damage waivers — a contractual limit Mylz places on your liability for loss of or damage to the vehicle. They are not insurance, Mylz is not an insurer, and buying a plan does not give you an insurance policy. Every rental includes Essential cover; you may upgrade to reduce your excess.
| Plan | Excess per incident | Price |
|---|---|---|
| Essential Cover | R25,000 | Included |
| Signature Cover | R7,500 | from R249 per day |
| Black Cover | R0 (zero excess) | from R449 per day |
While a waiver applies, you pay up to the excess for each separate incident, plus applicable administration costs disclosed in your quote. Damage is assessed and charged as explained in Damage, Excess, Deposits & Fines. Tyres, rims and glass are covered only if your plan includes them.
15.Traffic fines, tolls & e-tolls
You are responsible for all traffic, speeding, parking and by-law fines, toll fees and similar charges incurred during the rental period. Depending on where the offence occurs, infringements are administered under the Administrative Adjudication of Road Traffic Offences Act 46 of 1998 (AARTO) or under the Criminal Procedure Act 51 of 1977. Where the law allows, the registered owner or Mylz (as operator or proxy) will nominate you as the driver, or ask the issuing authority to redirect the notice to you, and will provide your details for that purpose.
We charge an administration fee of R250 per notice to cover nomination or redirection. Where an authority requires payment by the owner or operator, or the notice cannot be redirected, we may pay it and recover the amount plus the administration fee from you. We will send you a copy of every notice. You keep the right to contest any infringement with the issuing authority.
16.Tracking & telematics
Our vehicles are fitted with tracking and telematics devices that record location, speed, distance, ignition and driving-event data (such as harsh braking or impacts). We use this information for theft prevention and recovery, emergency and roadside assistance, verifying kilometres, fuel and return times, investigating accidents, damage and prohibited use, enforcing the rental agreement and complying with law. We do not monitor your trips in real time without cause. Access is limited to authorised staff and our tracking provider, as explained in our Privacy Policy (POPIA). You may not disable, remove or interfere with any device.
17.Your personal property
18.Changes, cancellations & no-shows
You may change or cancel a booking through your account or by contacting us. In summary (full detail in our Cancellations, Changes & Refunds):
- Cancellations at least 48 hours before the handover time: free, full refund.
- Cancellations less than 48 hours before handover: a cancellation charge of 25% of the rental charge.
- No-show (you do not take the vehicle and did not cancel): a charge of 100% of the rental charge.
These charges reflect our reasonable pre-estimate of the loss we suffer when a vehicle held for you cannot be re-let, as section 17 of the CPA permits. We will not impose a cancellation charge if you cannot honour the booking because of your death or hospitalisation (or that of the person for whom the booking was made), as section 17(5) of the CPA provides. If we cancel your booking for reasons not caused by you, you receive a full refund.
19.Liability & indemnity
Nothing in these terms excludes or limits: our liability for death or personal injury caused by our negligence; our liability for gross negligence; your right to safe, good-quality goods and services under sections 54 to 56 of the CPA; or liability that cannot be excluded under section 61 of the CPA (harm caused by unsafe goods or a product failure, defect or hazard). Third-party claims arising from the use of a vehicle on a public road may also be covered by the Road Accident Fund within the limits of the Road Accident Fund Act 56 of 1996.
20.Termination & repossession
We may terminate the rental agreement on notice to you and recover the vehicle if: you materially breach the agreement and do not remedy the breach within a reasonable time after we ask you to (or immediately where the breach cannot be remedied or creates a risk to people or the vehicle); the vehicle is used for prohibited purposes; you gave us false information; a payment or deposit hold is reversed or declined; or the vehicle is not returned when due.
Rental for the unused period after termination for your breach is refunded only to the extent we are able to re-let the vehicle.
21.Complaints & dispute resolution
Please raise any problem with us first so we can try to resolve it quickly — e-mail bookings@mylzrentals.co.za or follow our Complaints & Dispute Resolution process. We acknowledge complaints within 2 business days and aim to resolve them within 15 business days.
If you are not satisfied, you may refer the dispute to the Motor Industry Ombudsman of South Africa (MIOSA) at www.miosa.co.za, the National Consumer Commission at thencc.org.za, the Western Cape Consumer Protector, or a consumer court, or seek alternative dispute resolution under section 70 of the CPA. Privacy complaints may be lodged with the Information Regulator. Nothing in this clause prevents either party from approaching a court with jurisdiction, or from seeking urgent relief.
22.Governing law & jurisdiction
The rental agreement is governed by the law of the Republic of South Africa. Subject to your rights under the CPA, the parties consent to the jurisdiction of the magistrates' court having jurisdiction over the matter (including under section 45 of the Magistrates' Courts Act 32 of 1944); either party may also approach the Western Cape Division of the High Court, Cape Town, where the matter falls within its jurisdiction. Legal costs awarded by a court follow the court's order; we do not claim attorney-and-own-client costs from consumers unless a court orders it.
23.Notices & domicilium
Each party chooses as its address for service of legal documents (domicilium citandi et executandi): for Mylz, the registered address of Mylz Auto (Pty) Ltd as recorded with the Companies and Intellectual Property Commission (CIPC), available on request from bookings@mylzrentals.co.za; for you, the residential or business address given in your booking or account. Either party may change its address by written notice.
Operational notices (booking confirmations, statements, fine notices and changes) may be sent by e-mail, SMS, WhatsApp, in-app message or push notification to the contact details in your account, and are regarded as received as provided in section 23 of ECTA.
24.Extras, chauffeur service & loyalty points
Extras such as child seats, GPS units and Wi-Fi devices are subject to availability. You are responsible for fitting child seats correctly unless you ask us to fit them; we provide seats that meet the applicable safety standard. Lost or damaged extras are charged at replacement cost.
Where you book a chauffeur, the vehicle is driven by our professional driver, the damage-waiver and fines clauses do not apply to you for incidents caused by our driver, and you remain responsible for damage caused by you or your passengers, and for the chauffeur hours and kilometres booked.
Loyalty points are earned and redeemed on the terms published in your account. Points have no cash value, are not transferable and may expire as stated there; points earned on a booking that is cancelled or refunded are reversed.
25.General
- Whole agreement. The rental agreement is the whole agreement between us about the rental. No variation is valid unless confirmed by us in writing, which includes e-mail or a message through your account.
- Electronic signatures. You agree that the rental agreement, condition reports and other documents may be concluded and signed electronically and that electronic signatures and data messages are valid and binding under ECTA (including sections 11, 12 and 13).
- Plain language. These terms are written to be understood by an ordinary consumer. If anything is unclear, ask us before you sign; the CPA requires us to explain risky terms to you.
- Severability. If any provision is found invalid, the rest remains in force, and the invalid provision is read down to the extent the law allows.
- No waiver. Any delay or relaxation in enforcing a right does not waive that right.
- Assignment. You may not transfer your rights or obligations. We may cede our claims (for example to an insurer or a collection agent), without affecting your rights.
- Misuse. Unlawful access to or interference with our systems, booking platform or vehicle telematics may constitute an offence under the Cybercrimes Act 19 of 2020.
